Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Menciona, operated by BRESSAN INTERMEDIACOES LTDA, based in Rio de Janeiro, Brazil. By creating an account, starting a free trial, or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service. If you use the Service for an organization, you confirm you are authorized to bind it.

1. The service

Menciona is a tool for tracking and improving how a brand shows up in answers from AI tools. The Service includes the website, dashboard, the Menciona MCP server and any API, and related features that run prompts against third-party AI tools, analyze where your brand appears, audit your public pages, and keep a history of those results.

We may add, change, or remove features, models, and surfaces over time. The specific AI tools we can query depend on those third parties and may change without notice.

2. Eligibility and accounts

You must be at least 18 and able to form a binding contract. The Service is intended for business and professional use. You must keep your account information accurate and your credentials and API or MCP keys secure. You are responsible for all activity under your account, including your team members.

3. Authorized use

You may only add, track, and audit domains, brands, and prompts that you own or are authorized to monitor. You are responsible for the brand summary you confirm and the prompts you track, and for using the Service in compliance with applicable laws and the terms of the AI tools whose answers we surface.

4. Acceptable use

You agree not to, and not to allow anyone to:

• track or audit a brand or domain you are not authorized to monitor;
• abuse, overload, or violate the terms of the third-party AI tools we query;
• resell or sublicense the Service except as expressly allowed (for example, agencies managing client brands within their plan);
• reverse engineer the Service or use it to build a competing product;
• upload malware, attempt unauthorized access, or interfere with the Service;
• use the Service for unlawful, infringing, deceptive, or harmful purposes.

5. Plans, free trial, and billing

Paid plans include usage limits such as the number of prompts and audited websites. Current plans and prices are shown at checkout and on our pricing page. Every plan starts with a 14-day free trial; if you cancel before it ends, you are not charged. Unless you cancel, your subscription begins automatically when the trial ends.

Paid plans are billed in advance, monthly or annually, through Stripe, and renew automatically until you cancel. By subscribing, you authorize recurring charges. Prices are exclusive of taxes. We may change prices and features, effective at your next renewal, with reasonable notice.

You may cancel anytime from your account settings; cancellation stops future renewals and takes effect at the end of your current period. Except where required by law, payments are non-refundable and we do not credit partial periods or unused prompts. If a charge fails, we may retry, suspend, or downgrade your account.

6. Your data

To provide the Service we process the domains and public site content you add, your confirmed brand summary, your chosen prompts, the answers and audit results we generate, your account details, and billing information handled by Stripe. Our handling of personal data is described in our Privacy Policy.

You keep all rights to the data you provide. You grant us a license to host, process, and use it solely to provide, secure, support, and improve the Service, including querying third-party AI tools. Canceling stops new monitoring, but data already created stays visible in your dashboard until you delete it or close your account. You can access, export, or delete your data as described in the Privacy Policy. We may use aggregated, de-identified data to improve the Service.

7. MCP server and API

If you use the Menciona MCP server or any API, you are responsible for the assistants and tools you connect, the actions they take with your data, and keeping your keys secure. We may set and change rate limits, scopes, and usage requirements, and may modify or deprecate endpoints with reasonable notice where practical.

8. Suspension

We may suspend your access if we reasonably believe you are violating these Terms or creating risk, if your payment is overdue, or if a third party or law requires it. Where practical we will notify you and will restore access once the cause is resolved.

9. Third-party AI tools

The Service queries and reports on third-party AI tools such as ChatGPT, Gemini, Google AI Overview, and Google AI Mode. Menciona is not affiliated with, endorsed by, or sponsored by those providers, and all trademarks belong to their owners. Those tools are outside our control and may change their models, outputs, availability, or terms at any time, which can affect the Service. AI answers are non-deterministic and change constantly; we report what the models returned when we queried them, and results may vary or be inaccurate.

10. Intellectual property

The Service, including its software, design, content, scoring methodology, and trademarks, is owned by Menciona and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, and reserve all other rights. If you send us feedback, you grant us a perpetual, royalty-free license to use it.

11. Term and termination

These Terms apply from when you first access the Service until your account is closed or they are terminated. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, use the Service unlawfully, or create risk for us or others, and may discontinue the Service with reasonable notice. Terms that should survive termination, by their nature, do.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. Menciona reports and analyzes AI answers and provides recommendations, but does not guarantee any specific score, ranking, mention, citation, traffic, or business result, since outcomes depend on factors outside our control.

Parts of the Service may be offered as a beta or early-access release. Beta features are for evaluation, may change or be withdrawn at any time, may be unstable, and are excluded from any warranty. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD 100. These limits apply to all claims and survive any failure of a remedy. Nothing here limits liability that cannot be limited under applicable law.

14. Indemnification

You will defend, indemnify, and hold harmless Menciona and its personnel from claims, damages, liabilities, costs, and reasonable legal fees arising out of your data or use of the Service, your violation of these Terms or applicable law, or your tracking or auditing of a domain or brand you were not authorized to monitor.

15. Changes to these terms

We may update these Terms to reflect changes to the Service, the law, or our business. If a change is material, we will give reasonable notice before it takes effect. Changes apply going forward, and continuing to use the Service after a change takes effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, and the courts of Rio de Janeiro will have jurisdiction, except where mandatory local law provides otherwise. If any provision is unenforceable, the rest remains in effect. Neither party is liable for delays caused by events beyond its reasonable control, including outages of third-party platforms or AI providers. We may identify you as a customer in marketing unless you ask us not to.
